    Using a Last Will and Testament

    One of the most traditional and familiar methods for leaving real estate to children is through a last will and testament. A will allows a property owner to identify specifically who will inherit particular assets, including the family home or any other property held at the time of death. The document also designates an executor who bears responsibility for carrying out those instructions during the probate process.

    “While a will provides valuable clarity regarding inheritance intentions, property transferred through a will typically remains subject to full probate proceedings,” says Attorney Tyson Cross of Cross Law Group. Depending on the complexity of the estate and the volume of matters before the court, this process may extend for several months or longer. During that period, the court oversees the transfer of ownership and ensures that debts, taxes, and other obligations are resolved before property formally passes to the named beneficiaries.

    Using Revocable Living Trusts to Avoid Probate

    A significant number of Nevada residents turn to revocable living trusts as a means of transferring real estate to their children to circumvent the probate process entirely. A living trust is a legal entity established during the property owner’s lifetime, into which the title of real estate is transferred. The owner typically serves as the trustee and retains full control over the property during their lifetime.

    Living trusts offer several meaningful advantages. For example, trust administration generally occurs outside of public court records, providing a degree of privacy that probate proceedings cannot offer. A living trust also facilitates smoother property management in the event that the owner becomes incapacitated, as a designated successor trustee can step in to manage or distribute property according to the established trust terms without court intervention. Additionally, upon the owner’s death, the property passes directly and efficiently to the named beneficiaries.

    Transfer on Death Deeds in Nevada

    Nevada law also permits property owners to utilize a Transfer on Death deed as a straightforward mechanism for passing real estate directly to a designated beneficiary. This legal instrument allows the owner to name one or more individuals who will receive the property automatically upon the owner’s death.

    A Transfer on Death deed does not convey any ownership interest during the owner’s lifetime. The owner retains complete control over the property and may sell it, refinance it, or revoke the deed entirely at any point before death. Upon the owner’s passing, the property transfers to the named beneficiary without the need for probate proceedings. This approach can be particularly well-suited for parents who wish to designate a specific property to a particular child while maintaining full authority over that property throughout their lifetime.
